TERMS OF SERVICE

OVERVIEW

Welcome to Roadelier. These Terms of Service govern your access to and use of our website, online store, products and related services.

Throughout these Terms, “Roadelier”, “we”, “us” and “our” refer to the legal operator of Roadelier identified on the Contact Information page available in the footer of this website. “You” and “your” refer to any visitor, customer or user of the website.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and services.

By visiting our website or placing an order, you agree to these Terms of Service and to the policies referenced in them, including our Privacy Policy, Returns & Refunds Policy and Shipping Policy. If you do not agree with these Terms, you should not use our website or purchase our products.

Nothing in these Terms limits or excludes any mandatory consumer right that applies under the law.

SECTION 1 — ELIGIBILITY AND ACCOUNTS

You must have the legal capacity required in your country to place an order. If you are under the applicable age of majority, you may only use the website with the permission and supervision of a parent or legal guardian.

When placing an order or creating an account, you agree to provide accurate, current and complete information.

You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account. Please contact us promptly if you believe that your account has been accessed without authorisation.

We may suspend or close an account where reasonably necessary to protect customers, prevent fraud, comply with the law or respond to a material breach of these Terms.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

Roadelier offers wall art and related products, many of which are produced individually after an order is placed.

We make reasonable efforts to display product descriptions, dimensions, materials, colours and images accurately. However, colours may appear differently depending on your screen, device settings and lighting conditions.

Minor production variations may occur because of printing, cutting, stretching or assembly processes. These variations do not affect your statutory rights where a product is materially defective, damaged or different from its description.

Please review the product description, selected artwork, dimensions, orientation and other options carefully before placing an order.

We may update product descriptions, specifications, prices or availability for future orders without prior notice. Changes will not affect orders that have already been accepted, except where required by law or agreed with the customer.

SECTION 3 — MADE-TO-ORDER PRODUCTION

Most Roadelier products are made to order. Production may begin shortly after payment is confirmed.

The fact that a standard product is produced after an order is placed does not, by itself, remove any statutory right of withdrawal that applies to consumers.

Products created according to a customer’s individual specifications or clearly personalised may be excluded from the right of withdrawal where permitted by law. Any such exclusion will be made clear before purchase.

We may use third-party production, printing, fulfilment and logistics partners to manufacture and deliver orders. Roadelier remains the seller responsible to the customer for the order.

SECTION 4 — ORDERS AND CONTRACT FORMATION

By submitting an order, you make an offer to purchase the selected products.

After an order is placed, you will normally receive an electronic acknowledgement or order confirmation. A sales contract is formed when we accept the order and send confirmation, subject to successful payment authorisation.

We reserve the right to reject or cancel an order for legitimate reasons, including:

Payment failure or suspected fraud;
A clear pricing or product information error;
Product or production unavailability;
An undeliverable or incomplete address;
A breach of these Terms;
Legal, regulatory or intellectual-property concerns.

If we cancel an order after payment has been collected, we will refund the amount charged using the original payment method.

Please review your email address, delivery address, size and artwork selection before completing the order.

SECTION 5 — ORDER CANCELLATIONS

You may request cancellation before the product enters production or is marked as prepared.

Because production can begin shortly after purchase, cancellation is not guaranteed once an order has been confirmed. Contact us immediately at roadelier.shop@gmail.com and include your order number.

If cancellation is no longer operationally possible, any statutory withdrawal or consumer rights that apply after delivery remain unaffected.

SECTION 6 — PRICES, TAXES AND PAYMENT

Prices are displayed in the currency shown on the website or during checkout.

The total amount payable to Roadelier, including any applicable taxes and delivery charges collected by us, will be displayed before you confirm the order.

Standard shipping is currently offered free of charge to the supported destinations shown during checkout, unless expressly stated otherwise.

Orders delivered internationally may be subject to customs duties, import taxes, brokerage charges or other fees imposed by the destination country. Unless those charges are expressly collected during checkout, they are the responsibility of the recipient.

You agree to provide accurate payment and billing information and confirm that you are authorised to use the selected payment method.

Payments may be processed by Shopify Payments, PayPal or other authorised payment providers. We do not directly store complete payment-card details.

SECTION 7 — SHIPPING AND DELIVERY

Production and delivery estimates are indicative and are not guaranteed delivery dates unless we expressly agree otherwise.

Delivery may be affected by production capacity, destination, carrier operations, customs procedures, public holidays, severe weather or other circumstances outside our reasonable control.

We will deliver the order to the address supplied during checkout. You are responsible for ensuring that the address is complete and accurate.

Please consult our Shipping Policy for further information about production, delivery, tracking, customs, failed deliveries and multiple parcels.

Where consumer law applies, the risk of loss or damage remains with Roadelier until you, or a third party designated by you other than the carrier, physically receives the product. If you independently appoint a carrier that was not offered by us, risk may transfer when the product is handed to that carrier.

SECTION 8 — RETURNS AND RIGHT OF WITHDRAWAL

Consumers who have a statutory right of withdrawal may normally withdraw from an eligible online purchase within 14 calendar days from delivery without providing a reason.

Where several products from one order are delivered separately, the applicable period may begin when the final product is delivered.

To exercise the right of withdrawal, contact roadelier.shop@gmail.com or use any return or withdrawal function made available through the store. Your communication must clearly state your decision to withdraw.

After notifying us, you must return the eligible product within the applicable legal period and follow the return instructions provided by Roadelier.

Unless the product is defective, damaged, incorrect or otherwise non-conforming, the customer is responsible for the direct cost of voluntary return shipping when informed of this responsibility before purchase.

Where legally required, we will refund eligible payments, including the cost of the least expensive standard delivery method offered, within 14 days after being informed of the withdrawal. We may withhold the refund until we receive the returned goods or proof that they have been sent, whichever occurs first.

Refunds will normally be made through the original payment method without additional charges.

You may be responsible for a reduction in value caused by handling beyond what is reasonably necessary to inspect the product’s nature, characteristics and quality.

SECTION 9 — DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

Inspect your order after delivery.

If a product arrives damaged, defective, incorrectly produced or different from what you ordered, contact us promptly at roadelier.shop@gmail.com.

Please provide your order number, a description of the issue and clear photographs of the product and packaging where reasonably possible. Photographs help us investigate the production or delivery issue and do not remove any mandatory legal rights.

Where a lack of conformity is confirmed, we will provide the remedy required by applicable law, which may include replacement, repair where appropriate, a price reduction or a refund.

Any remedy for a validated defect or incorrect order will be provided without charge to the customer, including necessary shipping or collection costs.

SECTION 10 — STATUTORY GUARANTEES

Our products are covered by the mandatory legal guarantees and conformity rights applicable in the customer’s jurisdiction.

For consumers in Spain, Roadelier is responsible for qualifying non-conformities that exist at delivery and become apparent within the legally applicable period, which is currently three years for new goods.

These conformity rights are separate from the 14-day right of withdrawal.

Nothing in our commercial policies limits the remedies available to consumers under mandatory law.

SECTION 11 — REFUNDS

Approved refunds will be issued through the original payment method unless another method is expressly agreed and does not create additional costs for the customer.

The time required for the refund to appear may vary depending on the bank or payment provider.

We may request information reasonably necessary to verify the order, identity of the purchaser or basis of the request. This will not be used to unreasonably delay a refund or restrict a mandatory consumer right.

SECTION 12 — PROMOTIONS AND DISCOUNTS

Promotions, discount codes and special offers may be subject to separate conditions, validity periods, product restrictions or usage limits.

Unless expressly stated otherwise:

Discounts cannot be combined;
Discount codes have no cash value;
Discounts cannot normally be applied retrospectively;
Promotions may be changed or withdrawn for future orders.

Any change will not affect a completed and accepted order.

SECTION 13 — INTELLECTUAL PROPERTY

The Roadelier website and its contents, including artwork, photographs, graphics, designs, text, videos, branding, logos, product presentations and website layout, are owned by or licensed to Roadelier and are protected by applicable intellectual-property laws.

The Roadelier name and branding may not be used in a way that suggests endorsement, affiliation or ownership without prior written permission.

You may access the website for personal and lawful use. You may not reproduce, distribute, commercially exploit, modify, resell, republish or create derivative works from our content without permission, except where the law expressly allows it.

Purchasing a physical product does not transfer copyright or other intellectual-property rights in the artwork or design.

All third-party names, marks and content remain the property of their respective owners.

SECTION 14 — REVIEWS, PHOTOGRAPHS AND USER CONTENT

Where you voluntarily submit a review, photograph, comment or other content, you confirm that you have the right to submit it and that it does not infringe another person’s rights.

You grant Roadelier a non-exclusive, worldwide and royalty-free licence to display, reproduce and use that content for operating, improving and promoting Roadelier, subject to applicable privacy and consumer-protection laws.

We may remove content that is unlawful, misleading, abusive, discriminatory, defamatory, infringing or unrelated to the product or service.

You remain responsible for the content you submit.

SECTION 15 — ACCEPTABLE USE

You must not use the website:

For illegal, fraudulent or malicious activity;
To infringe intellectual-property, privacy or other legal rights;
To transmit malware, harmful code or deceptive communications;
To interfere with the website’s security or operation;
To collect personal data without lawful authority;
To impersonate another person or organisation;
To conduct unauthorised automated extraction, scraping or resale of our content;
To place fraudulent orders or abuse promotions, returns or payment systems.

We may restrict access where reasonably necessary to protect the website, our customers or our legal rights.

SECTION 16 — THIRD-PARTY SERVICES AND LINKS

Our website may contain services, applications or links provided by third parties, including Shopify, payment processors, production partners, carriers and social-media platforms.

Those third parties may operate under their own terms and privacy policies.

We are not responsible for independent third-party websites that we do not control. However, using a third-party provider to perform part of an order does not remove Roadelier’s responsibilities to the customer under the sales contract or mandatory law.

SECTION 17 — SHOPIFY

Roadelier uses Shopify technology to operate the online store.

Purchases made through this website are made from Roadelier, not from Shopify. Shopify is not the seller of Roadelier products and is not responsible for fulfilling orders, handling product complaints or providing product refunds.

This section does not limit any responsibility Shopify may independently have under applicable law or under services it directly provides to you.

SECTION 18 — PRIVACY

Personal information collected through the website is processed in accordance with our Privacy Policy.

Shopify and other service providers may process personal information to host the store, process payments, fulfil orders, prevent fraud and provide related services.

Please review the Privacy Policy available in the website footer for further information about the data collected, legal bases, recipients, international transfers, retention periods and your privacy rights.

SECTION 19 — AVAILABILITY AND WEBSITE INFORMATION

We aim to keep the website secure and available but cannot guarantee uninterrupted or error-free operation.

We may temporarily suspend access for maintenance, security, technical problems or circumstances outside our reasonable control.

We may correct genuine typographical, technical or pricing errors. If an error materially affects an order already placed, we will contact you and provide any remedy required by law, including cancellation and a full refund where appropriate.

SECTION 20 — LIABILITY

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, intentional misconduct or mandatory consumer rights.

To the maximum extent permitted by law, Roadelier is not liable for losses that were not reasonably foreseeable when the contract was formed or that result from circumstances outside our reasonable control.

For customers acting for business purposes, and to the extent permitted by law, Roadelier will not be liable for indirect losses, loss of profit, loss of business, loss of opportunity or loss of data.

These limitations do not apply where prohibited by mandatory law.

SECTION 21 — EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, war, civil unrest, government restrictions, labour disputes, transport disruption, customs delays, power failures, telecommunications outages or major supplier interruption.

We will take reasonable steps to reduce the effect of such events and will respect any cancellation, refund or delivery rights required by law.

SECTION 22 — GOVERNING LAW AND JURISDICTION

These Terms and contracts concluded through the website are governed by Spanish law.

If you are a consumer, this choice does not deprive you of any mandatory protection provided by the law of the country in which you habitually reside.

Any dispute will be submitted to the courts determined by applicable law. Consumers may bring claims before any court or authority available to them under mandatory consumer-protection and jurisdiction rules.

Nothing in this section prevents either party from using an available consumer complaint or alternative dispute-resolution procedure.

SECTION 23 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, it will be interpreted or limited only to the extent necessary. The remaining provisions will continue in effect.

SECTION 24 — NO WAIVER

A failure or delay by Roadelier in enforcing a right does not constitute a waiver of that right.

SECTION 25 — ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Returns & Refunds Policy, Shipping Policy, Contact Information and any conditions shown on the relevant product or checkout page, form the agreement between you and Roadelier concerning your use of the website and purchases.

In the event of a conflict, mandatory consumer law will prevail.

SECTION 26 — CHANGES TO THESE TERMS

We may update these Terms to reflect legal, regulatory, operational or service changes.

The updated version will be published on this page with a revised date. Material changes will be communicated where required by law.

Unless legally required otherwise, an order will be governed by the version of the Terms in effect when that order was placed.
